Abstract: The optimum definition of the term "genocide" has been hotly contested almost since the term was coined. Definitional boundaries determine which acts are covered and excluded and thus to a great extent which cases will benefit from international attention, intervention, prosecution, and reparation. The extensive legal, political, and scholarly discussions prior to this article have typically (1) assumed "genocide" to be a fixed social object and attempted to define it as precisely as possible or (2) assumed the need for (...) a fixed convention and sought to stipulate the range of events that should be denoted by the term. Even if its meaning is a matter of convention, however, "genocide" is not a fixed object but varies by context and evolves in methods and forms over time. In fact, as relevant laws, legal interpretations, and political commitments develop, so do would-be perpetrators modify what genocide is in order to avoid political and legal consequences. This article advances an approach to a definition of "genocide" that allows even legal definitions to keep pace with this evolutionary process. (shrink)

Benjamin Constant (1767–1830) is the most important French liberal that most casual liberals have never heard of. Everyone knows something about Montesquieu because checks and balances and the separation of powers are household terms. Tocqueville’s Democracy in America and The Old Regime and the Revolution are both established classics. But Constant is largely terra incognita even for those with a university degree—to their loss.

: Once cast aside as of no value, Charles S. Peirce manuscript 1570 "The First of Six Lessons . . ." and its context, provides uniquely valuable access to Peirce's religious practice (as distinct from his theology). Chronically unemployed, Peirce seized an opportunity to put in a bid for a vacant post in elocution at the Episcopal Church's major (and only "official") theological seminary, The General Theological Seminary in New York City. Peirce had on occasion appealed to nearby members of (...) the Episcopalian hierarchy seeking patronage for his scholarly work—to no avail. In this case, however, he was encouraged and aided by the current scholarly vicar of his own parish. The incumbent had pursued advanced education abroad and was also active in the seminary's affairs. And, of course, Peirce was confident about his expertise in elocution, which "General's" Dean claimed as well. Both the contextual narrative and the substantive theological content of his "lesson" are a rich resource for insights into the much vexed (if too often muddled) question of his lifelong commitment to a faith stemming from his earlier conversion to trinitarianism. This paper aims to do two things. First, it describes the place that Adam Smith actually occupies in current research occurring at the boundaries of new interdisciplinary social-science fields such as evolutionary anthropology, evolutionary psychology, neuro-economics and behavioral economics. Second, it suggests a way in which Smith's place in the debates with which these subjects are concerned may be more properly defined and conceptualized. Specifically, the paper focuses on the controversial new theory of strong reciprocity, and on the reputation effects (...) that its critics think that theory neglects. (shrink)

1. Introduction. Professor Nagel's account of the “cognitive status” of scientific theories has been attacked by P. K. Feyerabend [5] and M. B. Hesse [8] in terms of his alledgedly misguided distinction between experimental laws and theories. The difficulty lies, these critics agree, in Nagel's attempt to find a stable basis for scientific theories in an observational basis of experimental laws. Both Feyerabend and Hesse note the vacillation in Nagel's account of the stability of the meaning of experimental terms and (...) in his discussion of the status of observational as opposed to theoretical terms. They find Nagel too “positivistic” and see as a first step toward a more adequate account of scientific theories the abandonment of the theoretical-observational dichotomy as having more than a pragmatic significance. Nagel's discussion of the theoretical-observational dichotomy is, I agree, inadequate in certain respects. I shall, however, suggest a quite different remedy from those of Feyerabend and Hesse, one that depends neither on a phenomenalistic reduction of theoretical entities nor on a blurring of the theoretical-observational dichotomy. In this book, Charles Griswold attempts to make Adam Smith speak to a postmodern generation by taking an extended detour through antiquity. The frames of reference that pervade his long, thoughtful, unfailingly engaging, though not concisely written book include next to nothing about the significance of a "sympathy" theory for modern social psychology, or about evolutionary theory or modern economic theory. Nor is much effort made to pin down the eighteenth-century context of Smith's enterprise. Instead, the book takes Smith primarily (...) as a moral philosopher in the grand Western tradition, while nonetheless arguing for the deep meaningfulness of such a Smith to a postmodern audience. Evidence-based medicine (EBM), by its ability to decrease irrational variations in health care, was expected to improve healthcare quality and outcomes. The utility of EBM principles evolved from individual clinical decision-making to wider foundational clinical practice guideline applications, cost containment measures, and clinical quality performance measures. At this evolutionary juncture one can ask the following questions. Given the time-limited exigencies of daily clinical practice, is it tenable for clinicians to follow guidelines? Whose or what interests are served by applying performance (...) assessments? Does such application improve medical care quality? What happens when the best interests of vested parties conflict? Mindful of the constellation of socially and clinically relevant variables influencing health outcomes, is it fair to apply evidence-based performance assessment tools to judge the merits of clinical decision-making? Finally, is it fair and just to incentivize clinicians in ways that might sway clinical judgment? To address these questions, we consider various clinical applications of performance assessment strategies, examining what performance measures purport to measure, how they are measured and whether such applications demonstrably improve quality. With attention to the merits and frailties associated with such applications, we devise and defend criteria that distinguish between justice-sustaining and justice-threatening performance-based clinical protocols. In their environment, plants are continuously submitted to natural stimuli such as wind, rain, temperature changes, wounding, etc. These signals induce a cascade of events which lead to metabolic and morphogenetic responses. In this paper the different steps are described and discussed starting from the reception of the signal by a plant organ to the final morphogenetic response. In our laboratory two plants are studied: Bryonia dioica for which rubbing the internode results in reduced elongation and enhanced radial expansion and (...) Bidens pilosa for which the response occurs at distance, hence pricking the cotyledon of a plantlet induces the growth inhibition of both the hypocotyl and the axillary bud of the pricked cotyledon. Reception of the signal and transmission of the message. In Bryonia the signal is received by epidermal cells while in Bidens they are the cells adjacent to the midrib of the cotyledon which receive the mechanical signal. In both plants the message is transmitted via a wave of electric depolarization. This latter is composed of an action potential associated with a slow wave whose transmission rates are respectively 1cm s−1 and 1 mm s−1. Recent results have shown the involvement of Ca2+ in the triggering of the slow wave and the role of the H+ pump during the slow wave. Transient and fast biochemical responses. An entry of extraceilular Ca2+ into the cells and a transient increase in IP3 occur within seconds following the mechanical stimulus. At the same time, the membrane becomes more fluid, correlated with qualitative changes in phospholipids. The rapid increase in the concentration of peroxidated lipids may be correlated with ethylene biosynthesis which is stimulated after rubbing. Other parameters such as cytoplasmic pH, relative water content, hydric potential, membrane potential and modifications of K+, Mg2+-ATPase and Ca2+-ATPase activities, play a key role in the early responses induced by the traumatisms. Irreversible-biochemical responses. The mechanical stimulus performed on a Bryonia internode induces an acceleration of: i) enzymatic activities related to the lignification, ii) esterification of phenolic acids in the cell wall. Consequently the lignification process is accelerated. Storage of the information. After being received by the target cells the information can be stored during several days before being expressed. At the level of cotyledonary bud, the first message, previously stored, can be expressed or not by a second treatment. Bidens thus behaves as if it was able to “store” and to “retrieve” morphogenetic messages, using a sort of rudimentary memory. The nuclei of the bud cells of the pricked cotyledon show that these cells, initially in G2 phase, divide and then remain in the G1 phase. In Bryonia, calli derived from young stimulated internodes, keep thigmomorphogenetic characteristics during several weeks. In the last part of this paper the particularity of our plant model which permits a study of the transmission and storage of the message, is underlined. The links between the different steps induced by the stimulus are discussed. Special attention is devoted to second messengers and to the amplification of the message. (shrink)

Peirce, entitled Pragmatism and Pragmaticism, contains papers dealing with two distinguishable, but interconnected doctrines: Pragmatism and Critical Common-sensism. The latter, antedating in its earliest expositions the first formulation of the pragmatic doctrine in 1877, 8, is however later conceived by Peirce as a consequence of pragmatism. The two doctrines will be advisedly treated here in isolation, and first pragmatism.

This paper consists of commentaries about and the reprint of an autobiographical essay authored by Italian medium Eusapia Palladino and published in 1910. The details of the essay are discussed in terms of the writings of other individuals about the life and performances of the medium. The essay conveys a view of Palladino as a person who has suffered much in life and has a mission to help scientific research into mediumship. Typical of the positive emphasis in autobiographies in general, (...) the medium did not discuss negative aspects of her performances. Due to the fact that the essay appeared during Palladino's visit to New York City in which many authors branded her as a fraud, it may be speculated that the purpose of this autobiography was to elicit sympathy from the American public. While some of the statements that Palladino made about phenomena are consistent with the statements of other authors who have written about her, there are several statements that show alternate or incomplete versions of particular events in her life. The differences suggests that Palladino's essay and other discussions about the medium's life are not reliable when it comes to specific details and to biographical accuracy. (shrink)

ABSTRACTThe known works of the medieval astronomer/astrologer Henry Bate include a set of planetary mean motion tables for the meridian of his Flemish hometown Mechelen. These tables survive in three manuscripts representing two significantly different recensions, but have never been examined for their principles of construction or underlying parameters. Such analysis reveals that Bate employed an unusual value for the length of the tropical year, which was probably derived by comparing ancient and contemporary observations of the vernal equinox. In (...) addition, there are clear signs that Bate kept revising his parameters for the mean motions of Venus and the three superior planets, none of which can be traced back to earlier sources. Together with some of Bate’s preserved statements, these findings support the conclusion that the Tabule Machlinenses were unique among the astronomical tables produced in medieval Latin Christendom for using independently derived parameters that were the result of new observations. Bate’s achievement connects him to a wider milieu of astronomers operating in late-thirteenth-century Paris, who put an increased emphasis on observation and the critical examination of received data. Alfred North Whitehead 's treatise Universal Algebra classifies algebras as either non-numerical or numerical according to whether they satisfy the law of idempotency, a + a = a. We undertake a technical critique of this classification scheme and examine how its flaws may reflect certain mathematical and philosophical biases in Whitehead 's outlook. We argue further that Whitehead 's presumption of immutable foundations for mathematics and his early commitment to the priority of objects over relations may in part account for (...) his relative obscurity as a mathematician.
